1.General Provisions
The General Terms published herein (hereinafter referred to as "General Terms") are an integral part of the programs for day trips and tourist package arrangements (hereinafter referred to as "arrangements") provided by the travel agency T.A.G. Travel d.o.o., Pula, Istarska 38, VAT ID: 87542403982, ID Code: HR-AB-52-0400001891, registered with the Commercial Court in Pazin (hereinafter referred to as "the Agency"). These terms form a binding agreement between the traveler and the Agency or between the Agency and a third party beneficiary traveler under the contract (hereinafter referred to as "the Traveler"). All data and conditions specified in the arrangement program and these General Terms are binding on both parties unless otherwise stipulated in the Contract.
The terms used herein have meanings as defined by the Tourism Services Act (Official Gazette 130/2017), unless otherwise specified. Gender-specific terms used in these General Terms apply equally to all genders. If a specific program includes provisions that differ from these General Terms, the provisions specified in the program take precedence.
2.Contents of the Arrangement
Unless otherwise stated, the arrangement organizer is T.A.G. Travel d.o.o., which guarantees the execution of the published arrangement program as described, within the specified timeframe and at the agreed price, except in extraordinary circumstances beyond the Agency's control (e.g., war, unrest, strikes, terrorist actions, sanitary disruptions, natural disasters, government interventions, etc.). The arrangement program includes details about the destination, itinerary, travel period, arrangement price, services, payment terms, general passport and visa requirements, and other relevant travel information.
3.Arrangement Price
The arrangement price, expressed per person in euros unless otherwise stated, is valid from the date of publication. The Agency reserves the right to adjust the price due to changes in hotel, transport, or other service costs, or in cases of drastic price changes exceeding 10%. Prices are based on agreements between the Agency and its partners and may not match the prices published at the destination, so price differences are not subject to complaint. Travelers will be informed in writing of any price changes and receive an amended contract. If the Traveler does not cancel the trip in writing within two (2) business days of receiving the amended contract, it will be considered accepted. If the Traveler does not accept the new terms, the Agency will refund the amount paid. Price adjustments due to unforeseen circumstances beyond the Agency's control do not entitle the Traveler to compensation.
The arrangement price includes only the services specified in the travel program. Additional services are charged separately.
4.Applications, Reservations, and Payments
Travel applications can be made at the Agency's office, by phone, or via email. The Traveler must provide accurate and valid information necessary for the trip. The Agency is not liable for incorrect or incomplete personal data provided in the reservation, and the Traveler is responsible for related costs or consequences.
To confirm a reservation for day trips, full payment is required. For multi-day arrangements, an advance payment must be made by the specified deadline, with the balance payable by the agreed date. The Agency reserves the right to cancel reservations if payments are not made on time.
Hotels, apartments, transport, and other services in Agency programs are described according to official classifications valid at the country of the travel.
5.Accommodation
Room/apartment assignments are made by the accommodation's reception. Unless specifically agreed upon, the Traveler must accept any officially registered accommodation within the program's destination. Check-in is generally after 3:00 PM, and check-out is by 10:00 AM unless otherwise stated. Late arrivals (post-7:00 PM) must be reported to the Agency at least one day in advance if not specified in the travel program.
6.Traveler Responsibilities
Travelers must comply with the travel program, accommodation rules, and transportation guidelines, and cooperate with tour leaders and service providers. Any damages caused by the Traveler must be compensated immediately to the respective property or service provider. The Traveler is responsible for their personal safety during the trip. It is recommended to review travel advisories on the Croatian Ministry of Foreign Affairs website.
The Traveler must inform the Agency of any health issues that could affect the trip. The Agency is not liable for costs arising from undisclosed health problems.
7.Travel Documents
Travelers must have valid travel documents for the trip's duration. For non-Croatian nationals, it is advised to check travel requirements before booking. The Agency is not liable for issues arising from invalid documents.
8.Travel Insurance
The arrangement price includes travel health insurance unless otherwise stated. It is recommended to purchase trip cancellation insurance during booking, as it cannot be added later.
9.TRAVELER'S LUGGAGE
For air travel, the traveler is entitled to carry the number of pieces of hand luggage specified in the airline's regulations. Excess luggage is paid for on-site according to the airline's applicable price list.
For bus transportation, the traveler may bring up to two pieces of personal luggage. The traveler is responsible for the care of their belongings brought into the passenger cabin of the transport vehicle (train, airplane, bus, ship, etc.) and must take them along when leaving the vehicle at any stop. In the event of lost luggage, the traveler must file a report on-site with the carrier's representative and follow the applicable regulations.
For air travel, the airline is solely responsible for luggage, as per the regulations applicable to international transport.
In the case of lost luggage at the accommodation facility, the traveler must file a claim with the appropriate staff at the accommodation.
The agency is not responsible for luggage transportation and therefore bears no liability for damaged or lost luggage in the transport vehicle or for theft of luggage or valuables in the accommodation facility.
10. THE ORGANIZER'S RIGHT TO CANCEL OR CHANGE THE PROGRAM
The agency reserves the right to cancel the arrangement if an insufficient number of participants register, no later than 15 days before the start of multi-day trips and 48 hours before the start of one-day excursions. The minimum number of participants required for the trip is indicated in the offer for each arrangement. In the event of cancellation by the agency, the agency is obligated to refund the total amount paid.
In the case of extraordinary circumstances that cannot be foreseen, avoided, or eliminated (force majeure under applicable legal standards) and in other situations that prevent or significantly hinder the fulfillment of the trip, the agency reserves the right to modify the program as well as to change the date or time of travel due to schedule adjustments, without compensation, in accordance with applicable domestic and international transport regulations. If there is a change in the agreed accommodation, it can only be replaced with accommodation of the same or higher category. Any difference in accommodation costs will be covered by the agency. The agency does not assume responsibility for changes due to unforeseen circumstances and force majeure during the trip but will provide services considering the new circumstances.
11.CANCELLATION OF TRAVEL BY THE TRAVELER
A traveler or the trip contractor who wishes to cancel a paid arrangement must do so in writing. The date of the written cancellation is the basis for calculating cancellation costs. The cancellation costs are determined according to the date of cancellation and the type of trip.
In the event of cancellation, unless otherwise stated in the travel offer, the following cancellation terms apply:
– cancellation up to 30 days before departure: 100% refund
– cancellation from 30 to 15 days before departure: 50% refund
– cancellation from 15 to 7 days before departure: 25% refund
– cancellation within 7 days before departure: no refund
In cases of no-show or withdrawal after the start of the arrangement, 100% of the arrangement price is retained.
If the traveler voluntarily cancels the arrangement during the trip, they are not entitled to a refund or compensation from the agency, regardless of any travel cancellation insurance policy.
12.HANDLING COMPLAINTS
The traveler has the right to complain and request a proportional price reduction due to incomplete or improper services included in the arrangement. Each traveler must file a complaint individually, as group complaints will not be considered. Complaints must be submitted in writing (via email at info@tagtravel.hr, by mail, or personal delivery), accompanied by complete supporting documentation, no later than seven (7) days after the trip ends. The end of the trip is defined as the return to the departure point as per the trip program. Complaints submitted after this period will not be considered.
If the agency is at fault for the failure to deliver the program or part of the services, the traveler is entitled to compensation equivalent to the actual value of unused services. Claims cannot include already used services or the full arrangement price.
The agency must provide a written decision on the complaint within fourteen (14) days of receiving the written complaint. This deadline may be extended by an additional fourteen (14) days to gather information and verify the claims with service providers. The agency will only process complaints where the traveler provides proof that they initially filed a written complaint with the service provider on-site and that the issue could not be resolved on-site. Until the agency issues a decision on the complaint, the traveler irrevocably waives the right to involve third parties, courts, or disclose information to the media. During this time, the traveler also waives the right to initiate legal proceedings.
Complaints during the trip must be directed to the service provider on-site (e.g., reception, carrier, restaurant, or destination travel agency) and must include a written acknowledgment of receipt of the complaint. If the issue could have been resolved on-site with the service provider and the traveler failed to report it, or if the traveler did not complain in writing or by other appropriate means, it is assumed they were satisfied with the services, forfeiting the right to subsequent claims for compensation or refunds.
13.CONFIDENTIALITY AND PROTECTION OF PERSONAL DATA
The traveler voluntarily provides personal data. Personal data is required for identification and the realization of the agreed-upon service. It may also be used for further communication between the traveler and the agency. The agency commits not to disclose personal data to third parties, except when arranging travel insurance policies, in which case the data will be forwarded to the insurance company. Personal data will be stored in a database in accordance with the Data Protection Act and the agency's decision on the collection, processing, and storage of personal data.
14.FINAL PROVISIONS
The agency reserves the right to amend the text of the General Terms and Conditions at any time by publishing the revised text on its website, www.tagtravel.hr. Changes to the General Terms and Conditions take effect immediately upon publication. These terms and instructions for travel replace all previous terms and instructions.
The parties agree to resolve any disputes amicably. If an agreement cannot be reached or the traveler is dissatisfied with the resolution, the jurisdiction of the court in Pula applies, with Croatian law governing the dispute.
